1. Agreement to Terms

By accessing or using the Bucketlist Kenya website located at bucketlistkenya.com (the “Site”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to all of these Terms, you must not access or use the Site.

These Terms constitute a legally binding agreement between you (“User”, “you”, or “your”) and Bucketlist Kenya (“we”, “us”, or “our”), a publication registered and operating in the Republic of Kenya.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after any changes constitutes acceptance of those changes.

Bucketlist Kenya is a digital travel publication that provides editorial content including destination guides, travel news, safari itineraries, accommodation reviews, cultural features, and practical trip-planning information covering Kenya, East Africa, and international destinations.

3. Intellectual Property Rights

3.1 Our Content

3.2 Permitted Use

You may access, read, and share links to our content for personal, non-commercial purposes. You may quote brief excerpts (not exceeding 100 words) with proper attribution and a link to the original article.

3.3 Prohibited Use

Without prior written permission from Bucketlist Kenya, you may not:

Use our content for commercial purposes, including in paid publications, marketing materials, or competing services

4. User Conduct

We will not sell, rent, or share your email address with third parties for their marketing purposes.

6. AI Travel Assistant

The Site may include an AI-powered travel assistant chatbot. This feature is provided for general informational purposes only. You acknowledge and agree that:

Responses generated by the AI assistant are for general guidance and should not be relied upon as professional travel advice
The AI assistant may occasionally produce inaccurate, incomplete, or outdated information
You are responsible for independently verifying all travel information, including visa requirements, health advisories, safety conditions, pricing, and booking details
Bucketlist Kenya is not liable for any decisions made or actions taken based on information provided by the AI assistant
Conversations with the AI assistant may be logged for quality improvement purposes

7. Third-Party Links and Services

The Site may contain links to third-party websites, booking platforms, accommodation providers, airlines, tour operators, and other external services. These links are provided for your convenience and do not constitute an endorsement, guarantee, or recommendation by Bucketlist Kenya.

We have no control over the content, availability, privacy practices, or terms of service of third-party websites. You access third-party sites at your own risk and are subject to their respective terms and conditions.

Bucketlist Kenya is not a travel agency, tour operator, or booking platform. We do not process bookings, handle payments, or act as an intermediary for travel services unless explicitly stated otherwise.

8. Accuracy of Content

We make every reasonable effort to ensure the accuracy, completeness, and currency of the information published on the Site. However, travel information changes frequently, including but not limited to pricing, visa requirements, entry regulations, health advisories, operating hours, availability, and local conditions.

Bucketlist Kenya does not warrant or guarantee that:

All information on the Site is accurate, complete, or current at the time of reading
Prices, fees, or costs mentioned in articles reflect current market rates
Accommodation, services, or experiences described remain available or unchanged
Travel conditions, safety assessments, or regulatory requirements have not changed since publication

You are responsible for verifying all critical travel information with official sources, including government travel advisories, embassies, airlines, accommodation providers, and relevant local authorities before making any travel decisions or commitments.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

Bucketlist Kenya does not warrant that:

The Site will be available, uninterrupted, secure, or error-free at all times
Defects will be corrected in a timely manner
The Site or the servers that host it are free of viruses, malware, or other harmful components
The results of using the Site will meet your expectations or requirements

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BUCKETLIST KENYA, ITS DIRECTORS, EMPLOYEES, CONTRIBUTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, revenue, data, or business opportunities
Personal injury, property damage, or loss of life arising from travel undertaken based on information from the Site
Costs incurred from third-party services accessed through links on the Site
Damages arising from reliance on any content, advice, or recommendation published on the Site
Damages arising from unauthorised access to or alteration of your data or transmissions

In no event shall our total aggregate liability to you for all claims arising from or relating to the use of the Site exceed one thousand Kenyan Shillings (KES 1,000).

This limitation of liability applies regardless of the legal theory under which liability is asserted, including contract, tort, negligence, strict liability, or any other basis.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bucketlist Kenya, its directors, employees, contributors, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to:

Your violation of any third-party right, including intellectual property, privacy, or contractual rights

Any travel decisions or actions taken based on content accessed through the Site

Your User Content is not unlawful, defamatory, obscene, threatening, or otherwise objectionable

15. Advertising and Sponsored Content

16. Termination

We reserve the right to suspend or terminate your access to the Site, in whole or in part, at any time and for any reason, including but not limited to violation of these Terms, without prior notice or liability.

Upon termination, all provisions of these Terms which by their nature should survive termination shall remain in effect, including intellectual property provisions, disclaimers, limitations of liability, and indemnification obligations.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Site shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

Before initiating any formal legal proceedings, the parties agree to attempt resolution through good faith negotiation for a period of not less than thirty (30) days.

18. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Bucketlist Kenya regarding your use of the Site. These Terms supersede all prior agreements, understandings, representations, and warranties, whether written or oral, regarding the subject matter of these Terms.

20. Waiver

The failure of Bucketlist Kenya to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision shall only be effective if made in writing and signed by an authorised representative of Bucketlist Kenya.

21. Assignment

You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without our prior written consent. Bucketlist Kenya may assign its rights and obligations under these Terms without restriction.

22. Force Majeure

Bucketlist Kenya shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, wars, civil unrest, internet outages, cyberattacks, or failures of third-party service providers.
